Autopay Terms and Conditions

You authorize PHH Mortgages and its successors and assigns to initiate debit entries as indicated. You further authorize your financial institution noted above to debit your account. You agree to pay a returned item charge of up to $50.00 (as permitted by state law) for each returned item. If a debit is not made, you will promptly remit the total monthly payment plus any fees due. You are aware that the amount of the monthly payment may change from time to time, and that the amount of the monthly debit may change accordingly.

You agree to continue to send your payments by mail until you receive notification that the Direct Debit Program (ACH) is in place for your account. If you choose to sign up for the Paperless Billing option, you will access your statements online.

The Direct Debit Program (ACH Authorization) may be cancelled by either party with 3 days’ advance notice. However, if more than three debit entries are returned unpaid within a 12-month period, PHH Mortgage reserves the right to terminate your Direct Debit enrollment plan immediately without prior notice.

I (we) understand that the debit amount of the monthly payment electronically debited by PHH Mortgage may change in the event there is a corresponding change in the monthly payment due under the terms of the account. PHH Mortgage will provide notification of any mortgage payment changes at least 10 days before they occur.

Additional Authorization Terms
Contact in event of unauthorized transfer. If you believe an unauthorized transfer has been made or if you believe a transfer has been made using the information from your check and/or financial institution without your permission, call us at 1-800-449-8767 or write:

Business days. For purposes of these disclosures, our business days are Monday through Friday. Holidays are not included.

Confidentiality. We will disclose information to third parties about the account or the transfers:

  • Where it is necessary for completing transfers, or
  • In order to verify the existence and condition of the account for a third party, such as a credit bureau or merchant, or
  • In order to comply with government agency or court orders, or
  • If you give us your written permission.
Periodic statements. You have a right to receive a monthly account statement.

Right to stop payment and procedure for doing so. If you have told us in advance to make regular payments out of the account, you can stop any of these payments. Here's how: Call us at 1-877-744-2506 or write us at P.O. Box 24738, West Palm Beach, FL 33416-4738 in time for us to receive your request at least three (3) business days before the draft date of the next scheduled payment. If you choose to log on to our self-service web address at PHHMortgage.com you can request a stop payment on your ACH enrollment three (3) days prior to your next due date.

Liability for failure to stop payment of preauthorized transfer. If you order us to stop one of these payments three (3) business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.

Financial institution's liability. If we do not complete a transfer to or from the account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
  • If, through no fault of ours, the account does not have enough money to make the transfer.
  • If the transfer would go over the credit limit on the overdraft line.
  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
  • There may be other exceptions stated in our agreement with you.
In Case of Errors or Questions About Your Electronic Transfers. Call us at 1-800-449-8767 or write us at P.O. Box 24738, West Palm Beach, FL 33416-4738 or log on to PHHMortgage.com and email us as soon as you can if you think the mortgage account statement is wrong or if you need more information about a transfer listed on the mortgage account statement. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.
  • Tell us your name and account number.
  • Describe the error or the transfer you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information.
  • Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days. We will determine whether an error occurred within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit the account.

For errors involving new accounts or foreign-initiated transactions, we may take up to ninety (90) days to investigate your complaint or question. We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
